ORDINANCE NO. 2:D 1-7 D AN ORDINANCE OF THE VILLAGE OF STAPLEHURST, NEBRASKA, PERTAINING TO LOT SETBACK REQUIREMENTS; ADDRESSING BUILDING REGULATIONS UPON LOTS LOCATED WITHIN THE VILLAGE; AND TO PROVIDE FOR A TIME WHEN THIS ORDINANCE SHALL TAKE EFFECT. BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF STAPLEHURST, NEBRASKA: Section 1. MINIMUM AREA REGULATIONS. All construction of buildings upon lots located within the Village shall comply with the following setbacks requirements: Structures shall be placed no closer than Twenty Five Feet (25') from the front lot line and Five Feet (5') from the side and rear lot lines. Section 2. CORNER LOTS. Buildings on corner lots shall provide front yard setbacks of Twenty Five Feet (25') on one street side and Fifteen Feet (l5') on the other front yard and designate remaining yards as one rear and one side yard. Section 3. VARIANCES. Any person desiring to obtain a variance from the above setback requirements may submit a written application for a variance to the Village Board of Trustees and, after notice and hearing, the Board of Trustees may grant the variance, provided that it does not interfere with the property rights and interests of the Village in general and adjoining neighbors, in particular. Section 4. GRANDFATHER CLAUSE. All existing buildings within the Village as of the date of passage of this Ordinance that are not in compliance with the above setback requirements shall be considered lawful and shall not be subject to this ordinance. Section 5. PUBLICATION; POSTING. This ordinance shall be published by posting a written or printed copy thereof in each of three public places within the Village, and shall be in full force and effect from and after its passage, approval, and publication or posting as provided by law and Village ordinance.
