VILLAGE OF STAPLEHURST, NEBRASKA LEGAL NOTICE The Village of Staplehurst, Nebraska, has declared its intention, by Resolution duly adopted by the Chairperson and Board of Trustees, to convey the following described real property, to wit: A parcel of land in the West Half, Southeast Quarter, Section 26, Township 12 North, Range 2 East of the 6th P.M., Seward County, Nebraska, more particularly described as follows: Commencing at a point on the east line of First Street, 30 feet east of the Southeast Corner of Lot 1, Block 14, in the Village of Staplehurst; thence north on the east line of First Street, a distance of 150 feet; thence east deflection angle 90°00’ Right a distance of 150 feet; thence south deflection angle 90°00’ Right a distance of 107 feet more or less to the centerline of the Blue River; thence southwesterly along the centerline of the Blue River to a point 150 feet south of the north line previously described; thence west to the place of beginning, containing 0.5 Acres more or less. This conveyance is proposed as part of a coordinated exchange of real property with the adjacent landowners. It has been determined that the legal description of the property previously conveyed to the Village does not accurately correspond with the actual, as-built location of the Village’s sanitary sewer infrastructure. The infrastructure is located on an adjacent parcel, and the exchange is intended to correct the legal descriptions so that the public record conforms to the actual location of the improvements. The Village intends to convey the above-described property to the adjacent landowners by quitclaim deed, in exchange for a conveyance to the Village of the parcel upon which the sanitary sewer infrastructure is actually located, subject to compliance with all applicable Nebraska laws governing the conveyance of real property by a municipality. If within thirty (30) days after the third publication of this Notice, a remonstrance petition against such conveyance (a) which conforms to Neb. Rev. Stat. § 32-628, (b) is signed by registered voters of the Village equal in number to thirty percent (30%) of the registered voters of the Village voting at the last regular municipal election held in the Village, and (c) is filed with the governing body of the Village, then such property shall not be conveyed, nor shall it be conveyed within one (1) year thereafter. If the date for filing such petition falls upon a Saturday, Sunday, or legal holiday, the signatures shall be collected within the thirty-day period, but the filing shall be considered timely if filed or postmarked on or before the next business day.
