THE SEWARD COUNTY BOARD OF COMMISSIONERS RESOLUTION NO. 3868 WHEREAS, the Seward County Board of Commissioners have directed the Seward County Highway Superintendent by resolution to examine the following described road, and, WHEREAS, the Seward County Highway Superintendent has made his examination, submitted his report, and WHEREAS, the Seward County Highway Superintendent’s recommendation to the Seward County Board of Commissioners at their Tuesday, July 29, 2025 meeting is to vacate the county road and associated statutory 66’ wide county road right-of-way located in Seward County, Nebraska. The road is more particularly described below. WHEREAS, the report of the Highway Superintendent shall be retained in the office of the county clerk as a part of the permanent public records of the county board; WHEREAS, the Seward County Commissioners deem that it may be in the public interest of Seward County to vacate the road, therefore a public hearing shall be held to determine if this road should be vacated, and, WHEREAS, by adopting this resolution the Seward County Board of Commissioners have directed the Highway Superintendent to proceed with further requirements for vacating this road; and, WHEREAS, the road is described as follows: [C]ommencing at the southwest corner of the north half of the southwest quarter of section 21, township 12 north, range 4 east of the sixth p.m., Seward county, Nebraska; thence east 1731 feet; thence s07°06’w, 561 feet; thence s81°28’e, 396 feet; thence n39°49’e, 146 feet; thence s68°28’ east, 132 feet; thence s18°53’e, 852.5 feet to the point of termination at the southeast corner of the southwest quarter of said section 21 WHEREAS, the road is not within the zoning jurisdiction of a city of the first class. NOW THEREFORE BE IT RESOLVED that the previously described road will be considered for road vacation at the Seward County Commissioners Meeting on August 26, 2025 at 9:15 AM, located at Seward County Courthouse, 529 Seward Street, Room 204, Seward, NE and, FURTHER BE IT RESOLVED that the Highway Superintendent is directed to: A. Publish this resolution in the Seward County Independent once a week for three consecutive weeks; B. Serve copies of this resolution by certified mail upon the owners of the land abutting on or adjacent to the road to be vacated to the mailing to the last-known address of each owner not less than two weeks in advance of the hearing.
