Swicord’s appeal denied on jurisdiction, not merit

DEA Task Force Coordinator Blake Swicord’s appeal against Nebraska Police Standards Advisory Council was dismissed on July 28 by the Nebraska Supreme Court.

“Because the district court lacked jurisdiction, we acquired no jurisdiction, and Swicord’s appeal must be dismissed,” the disposition stated.

The disposition was given does not involve a factual dispute regarding the merits of Swicord’s appeal.

The appeal was filed in August 2022 by Swicord’s legal counsel for relief after being denied admission into the basic officer certification training program at the Nebraska Law Enforcement Training Center when he moved to Nebraska from Georgia, after working in law enforcement there.

Swicord was denied into the program after answering “No” on his application to the question “have you ever had a professional license that you hold under investigation.”

“Law enforcement officers are not professionally licensed like a doctor or an attorney,” Swicord said. “Law enforcement officers receive a certification, but that question was not on the application.”

Swicord intends to explore all avenues of appeal against the Nebraska Police Standards Advisory Council.

According to Sheriff Mike Vance in a statement on Aug. 5, Swicord will continue to remain in his role as a civilian DEA task force coordinator for the department.
