STATE OF NEBRASKA NEBRASKA POWER REVIEW BOARD IN THE MATTER OF THE NORRIS PUBLIC POWER DISTRICT’S PETITION TO AMEND SECTION 6 OF ITS CHARTER PETITION FOR CHARTER AMENDMENT 20 NOTICE Notice is hereby given that on November 6, 2019, the Norris Public Power District (the District) filed a petition with the Nebraska Power Review Board seeking approval of a proposed amendment to its Charter (also known as a “Petition for Creation”). This would be the twentieth amendment to the District’s charter. November 6, 2019, the Norris Public Power District’s Board of Directors approved a resolution stating that the following amendments should be made to the District’s charter. The proposed amendments to section 6 are shown below. Language to be removed is shown with strikethrough and new language to be added is underlined. All other charter language will remain unchanged. That the Board of Directors of Norris Public Power District shall consist of 13 12 members. If the Board receives any protests, complaints, or objections on or before December 18, 2019, from a person residing in the Norris Public Power District’s service area, or any other person or entity affected by the proposed amendment, the Power Review Board will hold a hearing, at which the person filing said protest, complaint, or objection may appear and contest the approval of the District’s proposed amendment. The Board hereby provides notice, pursuant to the Nebraska Administrative Procedure Act, that in the event of a contested hearing, if any party requests that the Board be bound by the formal rules of evidence, all costs of the hearing shall be paid by the party or parties against whom a final decision is rendered. Pursuant to the Board’s Rules of Practice and Procedure set out in Nebraska Administrative Code, Title 285, Chapter 3, section 29.04, if for some reason there is no final decision in which a party requested that the Board be bound by the formal rules of evidence, the costs of the hearing will be borne by the parties to the hearing in a proportionate share according to their respective contribution to the record, unless otherwise ordered by the Board.
