CITY OF MILFORD FEBRUARY 3, 2026 The following is a condensed form of minutes: A complete copy is on file at the Milford City Hall, 402 1st St., Milford, NE, or on the city’s website: milfordne.gov The Mayor and Council met in regular session on February 3, 2026 at 7:00 pm. Mayor Kelley called the meeting to order at 7:00 pm. Present: Bauer, Freeman, Parks. Absent: DeLong. Nebraska Open Meetings Act requirement met. APPROVE AGENDA AS SUBMITTED: Approved the agenda as presented. PUBLIC COMMENT: None CONSENT AGENDA: Mayor Kelley read the Consent Agenda: a. Approve Minutes: January 6, 2026 b. Approval of Claims: Totaling $219,527.74 c. Approved Treasurer’s Report for 12/25 d. Reports/Communications filed by Governing Board and City Personnel. e. Re-appointments – Boards and Committees SALARIES: $44,945.82 GENERAL FUND: (See attached) PRESENTATION: Audit Report by HBE CPA’s 2024-2025 Fiscal Year: Lucas Post and Kiley Wiechman with HBE provided the findings from the 2024-2025 Fiscal Year End Audit. CURRENT BUSINESS: Consider potential revisions and updates to City Employee Handbook related to process and procedures for vacation, paid time off, and other employee leave requests, along with other potential revisions necessitated by new City payroll system. With the change of software we need to update the Employee Handbook to reflect the new procedure of adding Vacation and Ill leave. The new pay clock system requires time to be distributed by per pay period or bi-weekly instead of at the end of the month. Mayor Kelley will be reviewing timecards and approving the department head’s timecards prior to the payroll process. Council approved the revisions to the city employee handbook with the addition of verbiage in the second to last paragraph on page 14 adding (or Mayor as applicable). Consider 2025 Water Main Replacement project and advise on the use of remaining SRF funds. Dane Simonsen with JEO shared an update on the water main project. Reviewed the last set of plans, in depth, so they're basically at a 99% completion level rate. Regarding funding, we're using up the last half of the loan that funded the previous project. It was decided that we were going to design probably more water mains than we could build with that amount of money. And so right now, you have about $2 million of SRF funds left, and the total project cost of everything we've designed this time around is probably about 3.5. We won't know until we get bids. We have been talking to SRF and have kind of requested if they had any additional funds that we would like to know about it to enable us to do more. That’s where we're at from a budget standpoint. No action needed. Authorize going out for bid on 2025 Water Main Replacement project. We’re ready to finalize the plans. We'll sign and seal the plans and the specs. We'll proceed with permitting to the State of Nebraska for our construction permit. We're asking tonight for approval, and authorization to go out to bid. Council approved the plans and authorized JEO to go out for bids on the 2025 water main replacement project, utilize the remainder of the SRF funds available to get us as far as we can get into the project. Requested Agenda Item from Jeff Bluhm: Discuss and consider updating rules for ATV/UTV concerning driving at night and reviewing overall rules. Jeff Bluhm wanted to discuss the rules as far as all the side by sides/golf carts/ATV and UTV’s. Jeff has a fully enclosed side by side with heat and air and pretty much everything that a vehicle has to drive down the street. I do look at this as a privilege and I'm thankful for that. I just think if somebody has a vehicle that's equipped, which I've even seen, golf cart type vehicles that have, literally, headlights, taillights, blinkers, horns. I just want to be able to utilize the type of machine I bought. I don't know what other communities do. Mayor Kelley –Deferring to our legal team, is there any concern from laws outside of what we know that would hinder or disallow an ATV or UTV. Attorney Aerts noted there is a state statute for both the golf carts and the ATVs, they're directly on point that basically restricts operation on the public streets between sunset and sunrise unless you're doing snow removal or a trade. As far as a side by side or a RUV it’s a totally different category than a golf cart. I can tell you right now there's an ATV statute directly on point that says you can't drive it after dark. But in terms of some of these other hybrid vehicles, or more modern vehicles, not something that we've looked into. Attorney Aerts noted he would share the state statute pertaining to these vehicles and suggested looking into what other communities are doing. Item will be revisited. Consider By-Law change for the SSCSWMA regarding weighted votes per community. Council member Parks shared some of the frustrations around conducting a meeting with SSCSWMA. There is one person from Crete and one person from Seward that have 7 votes each. When one of them is not present the board cannot conduct their meeting and the treasurer cannot pay bills. One particular meeting they had a CD that was due and she needed approval to renew it. They did not have a quorum. They are proposing to change the By-Laws to where everyone has their own vote. Misty noted there are 2 options that the group will work through. The final red-line draft can be reviewed by Attorney Aerts and then brought before the council for approval. Council authorized Parks to work on behalf of the City of Milford to explore changes of the SSCSWMA by-laws pertaining to voting, which will be presented to the City Council for final approval. Consider updating Golf Cart ordinance allowing driving at night and adding providing proof of insurance. No discussion: State Statute clarifies no golf carts are allowed to be driven at night. The proof of insurance for golf carts will be added to the ordinance and placed on next month’s agenda. Discuss/consider rules and regulations for E-Bikes, Scooters, Hover Boards (All Electric) personal transportation within Milford. Councilmember Bauer provided information for discussion regarding interest in creating an ordinance pertaining to electronic types of transportation. He wanted to focus on e-bikes and scooters, which are most common right now. Items mentioned: Following traffic laws, no passengers, helmets for under the age of 16, speed. Riding on streets or sidewalks posed a concern because Milford does not have sidewalks in all areas of town. Education and parental guidance seemed to be key in all aspects. Suggested that Chief Kremer present a safety class at the Elementary School. Mayor Kelley noted it’s tough in a small community, we do not have bike paths or walking trails and sidewalks are limited. Probably not ready to put anything in place right now. Continue exploring what other communities are doing and definitely pursue the education piece. Bauer will continue research and review the current bicycle ordinance for a possible amendment. RESOLUTIONS AND ORDINANCES: RESOLUTION NO. 683 A RESOLUTION OF THE CITY OF MILFORD, NEBRASKA, AUTHORIZING AND DIRECTING THE SALE OF CERTAIN PERSONAL PROPERTY KNOWN AS A 1949 FORD F-7 FIRE TRUCK OWNED BY THE MILFORD VOLUNTEER FIRE DEPARTMENT, AND SETTING FORTH CERTAIN TERMS AND CONDITIONS RELATED THERETO. WHEREAS, the Milford Volunteer Fire Department (the “Fire Department”), a Department of the City of Milford, Nebraska (the “City”), owns a 1949 Ford F-7 Fire Truck (herein the “Property”); WHEREAS, it has been determined that the total fair market of the Property is greater than Five Thousand and No/100 Dollars ($5,000.00); WHEREAS, the Fire Department has approved the sale of the Property and now wishes to obtain the approval of the City Council regarding the sale of the Property; and WHEREAS, the City desires, through this resolution, to authorize and direct the sale of the Property pursuant to Neb. Rev. Stat. § 17-503.02 and Milford City Code § 8-103, as amended, and in accordance with such other terms and conditions as set forth herein. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF MILFORD, SEWARD COUNTY, NEBRASKA, that the City authorizes and directs the sale of the Property, as follows: Section 1. The City finds and determines that the total fair market of the Property is greater than Five Thousand Dollars ($5,000.00), such that the procedures and requirements set forth in Neb. Rev. Stat. § 17-503.02 and Milford City Code § 8-103(11) for personal property of greater than $5,000.00 in value shall apply to the sale of the Property. Section 2. The Property shall be sold pursuant to the following terms and conditions: 1) In accordance with the notice requirements set forth below, as such other terms and conditions as set forth herein, the City Council hereby directs that the Property shall be sold by the Fire Department to Firehouse Mid-Mod Custom Vintage, whose principal owners are Lynda Wirnsbeter and Brett Taylor, of St. Louis, Missouri (collectively, the “Purchaser”). 2) The purchase price for the sale of the Property to the Purchaser shall be SIX THOUSAND NINE HUNDRED SEVENTY AND NO/100 DOLLARS ($6,970.00), and the Property shall be sold “as-is,” and Purchaser shall be responsible for all costs associated with the closing on the sale of the Property, including but not necessarily limited to, all costs associated with any sales tax, transfer taxes, motor vehicle registration fees, or costs for obtaining new insurance for the Property, as applicable, and any costs of pickup and transport of the Property. Section 3. Pursuant to Neb. Rev. Stat. § 17-503.02 and Milford City Code § 8-103(11), following the passage of this Resolution, notice of the sale of the Property shall be posted in three (3) prominent places within the City for a period of not less than seven (7) days prior to the sale of the Property. Notice of the sale shall also be published once in a legal newspaper in or of general circulation in the City at least seven (7) days prior to the sale of the Property.
