TRISTA ANNE LONGSINE, Third-party Defendant. CASE NO. CI14-126 COMPLAINT FOR MODIFICATION AND PRAECIPE COMES NOW the Defendant, and for his cause of action, sets forth as follows: 1. The minor children which are the subject of this action are domiciled and located in Seward County, Nebraska. 2. This matter should be heard by a district court judge. 3. No party is in the military service of the United States or its allies within the meaning of the Service Members Civil Relief Act of 2003. 4. Defendant is not aware of any other action for custody, parenting time, guardianship, or any other action involving the minor children. 5. On or about the 1st day of April, 2016, this Court entered an Order For Support finding, among other things, that Defendant was the natural father of the minor children. As part of the aforementioned Order, the Third-Party Defendant was awarded custody of the minor children, and Defendant was ordered to pay support on behalf of the minor children in the amount of $440.00. 6. Since the entry of the Order For Support, there has been a substantial and material change in the circumstances of the Parties, to-wit: the income of the Parties has changed such that application of the child support guidelines which would result in a variation by 10 percent or more, but not less than $25, upward or downward, of the current child support obligation, child care obligation, or health care obligation, due to financial circumstances which have lasted 3 months and can reasonably be expected to last for an additional 6 months, 7. Since the entry of the Order For Support, there has been a substantial and material change in the circumstances of the Parties that would result in a change of the custody of the minor children and/or parenting time with the minor children, and a review of the same would be in the best interests of the minor children. 8. Applying the current support obligation would place Defendant below the poverty guidelines, in violation of Nebraska Supreme Court Rule $4-218. 9. The Nebraska Child Support Guidelines have been amended to reduce Defendant's child support obligation, 10. No deterinination has been made as to the tax exemptions for the minor children. WHEREFORE, Defendant prays the Court for an Order modifying his child support obligation in accordance with the facts and the law, modifying the custody and/or parenting time regarding the minor children, for a determination of tax exemptions based on the minor children, and for such other and further relief as may seem just and equitable in the premises.
