The Nebraska Attorney General's office and the Seward County Attorney filed a notice of intention to seek review with the Nebraska Court of Appeals March 14.
The court is being asked to review the suppression orders issued by Seward County District Court Judge Alan Gless Feb. 20. In the ruling, Gless said law enforcement repeatedly questioned Lucas Peterson without reading him his Miranda rights and without counsel present while they were investigating the disappearance of Peterson's daughter, 11-month-old Trista.
The Court of Appeals will assign one judge to handle the review and make a determination.
A second appeal may be filed later dealing with the cooperation agreement Peterson agreed to before he took deputies to Trista's grave in rural Butler County.
According to Gless's ruling, Peterson agreed to take deputies to Trista because he thought the pending felony charges against him would be replaced with misdemeanors.
The attornies have until March 21 to receive permission to file the appeal on the cooperation agreement. If permission is granted, they then have 30 days to file.
